Terms of Use

Last updated October 12, 2026

These terms are the rules for using Gymment, the software gyms use to run their classes, memberships, check-ins and payments. Gymment is operated by The Eagles Marketing ("The Eagles Marketing", "we" or "us"). By creating an account or using the service you agree to these terms with The Eagles Marketing.

What Gymment is

Gymment is software, built and run by The Eagles Marketing. We are not your gym, we do not run classes, and we are not a party to the agreement between a gym and its members. A membership, class, product or price is an arrangement between you and your gym.

The Eagles Marketing does not give training, medical or legal advice through Gymment. Martial arts and fitness carry a risk of injury, and that risk is between you and your gym.

Your account

Give accurate details, keep them up to date and keep your login private. You are responsible for what happens under your account, and you should tell us right away if you think someone else is using it.

You must be an adult to open a gym account or to accept these terms for yourself. A child's records are created and managed by the gym or by a parent or guardian, who acts for them.

If you run a gym

The gym owner is responsible for how the gym uses Gymment. That includes:

  • The roles and permissions given to staff, and who can see members' records.
  • The accuracy of prices, memberships, schedules, fees, refunds and cancellation rules.
  • The content of waivers and other documents, and whether they work for your gym and your location. Gymment provides the tools to collect signatures and does not review your documents.
  • Getting the permissions you need to hold members' information and to message them, including a parent's or guardian's permission for children.
  • Following the laws that apply to your business.

If you are a member or guest

Use Gymment as your gym allows. Check-in codes are for you only. Class reservations, waiting lists, cancellation and attendance rules are set by the gym, not by Gymment.

Plans and fees

Gymment is free for gyms with up to 15 active students. Past that, it is a flat monthly fee paid to The Eagles Marketing, whether the gym has 16 students or 1,600. The current numbers, and what counts as an active student, are on the pricing page, and we will give notice before changing them.

We do not take a percentage of the payments your members make. Stripe's processing fees still apply, and they are charged by Stripe, not by us.

Payments, refunds and disputes

Online payments are processed by Stripe and are subject to Stripe's own terms. By paying, or by turning on automatic payments, you allow the gym to charge the payment method you chose for what you owe it.

Payments from a bank account can take several business days to settle and can be returned, for example for insufficient funds or an incorrect account. Charges, refunds and disputes between a member and a gym are handled by the gym, and The Eagles Marketing is not the seller.

Documents and electronic signatures

When you sign a document in Gymment, you agree that the electronic signature has the same effect as a handwritten one where the law allows. We keep the wording you agreed to, your signature, the date and time, and the IP address and browser you signed from. For a child, an adult guardian signs.

Acceptable use

Do not:

  • Share your account, or misuse another person's check-in code.
  • Try to reach another member's, gym's or company's data, or get around permissions and security.
  • Upload content that is unlawful, harmful, infringing or that you do not have the right to share.
  • Use Gymment to send spam or messages that members have not agreed to receive.
  • Interfere with the service, overload it, scrape it or try to copy its code.

Your content

You keep ownership of what you put into Gymment, such as photos, videos, documents and records. You give us permission to store, process and show that content only as needed to run the service for you and your gym. You confirm that you have the right to upload it.

Putting Gymment on your website

A gym can add Gymment's sign-up form or student app to its own site. The gym is responsible for that site and for telling its visitors what it collects. What visitors enter into the Gymment form is handled as described in the Privacy Policy.

Messages and notifications

We send the emails and notifications the service needs, such as receipts, reminders, notices about documents and waiting-list updates. You can turn push notifications off in your browser at any time.

Availability and changes

We work to keep Gymment running, but we cannot promise it will always be available or free of errors. We may change, add or remove features, and we may pause the service for maintenance.

Suspension and ending your account

You can delete your account at any time from Profile. We may suspend or close an account that breaks these terms, puts others at risk, or is used for fraud. What happens to your information afterwards is described in the Privacy Policy.

No warranties

Gymment is provided as it is and as it is available. To the extent the law allows, we make no promise that it will meet your gym's particular needs or that it will be uninterrupted or error free.

Limit of liability

To the extent the law allows, The Eagles Marketing is not responsible for indirect or consequential losses, lost income or lost data, or for anything that happens at a gym, including injuries and disputes between members and gyms. Our total liability for any claim about the service is limited to what you paid us in the 12 months before the claim, or 100 US dollars if you paid nothing. Nothing here limits rights that the law does not allow to be limited.

Claims about a gym's own content

A gym owner agrees to cover The Eagles Marketing against claims that come from the gym's own content, documents, rules or use of the service in a way that breaks these terms or the law.

Problems and disputes

If something goes wrong, write to us first at contact@theeaglesmarketing.com and we will try to sort it out. Anything the law gives you that these terms cannot take away stays in place.

Changes to these terms

We may update these terms. The date at the top shows the latest version, and for important changes we will tell account holders in the app or by email. If you keep using Gymment after a change, you accept the new terms.
